In recent years the co-existence of the power to amend judgements and orders and statutory deadlines has been an area of some controversy in relation to statutory deadlines in both the bankruptcy and corporation law contexts. After some doubt and hesitation the view prevailed that the slip rule could be used to extend a statutory deadline after that deadline had expired. An order amended under the slip rule would have the effect of retrospectively extending the statutory deadline. However recent cases suggest that that approach may be wrong.
