Liquidated damages and what would the High Court have decided in the appeal in Interstar Wholesale Finance Pty Ltd v Integral Home Loans Pty Ltd

The seminar will consider the current law on liquidated damages and penalties. It will also consider the NSW Court of Appeal decision in Interstar Wholesale Finance and the possible outcome of the appeal to the High Court. Dr Elisabeth Peden is a barrister in St James Hall Chambers. She is also a Professor of Law at the Faculty of Law, University of Sydney, where she teaches courses in contract and commerical law. She is the author of numerous articles on various aspects of contract law. She has written the book 'Good Faith in the Performance of Contracts' and co-authored 'Contract Law in Australia', 5th edition with JW Carter and GJ Tolhurst, and 'Uniform Evidence Law: Materials', 3rd edition with Odgers and Kumar. She has appeared in significant cases in many jurisdictions.
